Terms of Service
These are the terms you agree to by using FreeHeadshot.org. We tried to write them like a person would talk, not like a 1990s software license. Where the law forces a specific phrase, that phrase shows up. Everything else is in plain English with a short callout under each dense section that summarizes what the section actually means.
The 30-second version
- You upload a selfie. We turn it into AI headshots. You own the resulting images and can use them however you want for personal or commercial work.
- Free tier is genuinely free. Paid tiers are one-time purchases. No subscription, no auto-renewal.
- 24-hour refund window on every paid tier if you've used 3 or fewer photos. EU and UK consumers keep their statutory rights on top.
- Don't use the service to make images of someone who is not you. Don't try to fake an ID. Don't try to make exploit content. We can suspend an account if we have a reasonable basis to believe it's being used this way.
- AI output is not perfect. If a generation fails, regenerate. If you bought a paid pack and the results are not usable, request a refund inside the 24-hour window — eligibility requires you to have used 3 or fewer photos.
- Disputes get resolved by email first. If that fails, arbitration. EU and UK consumers keep all the rights their local law gives them on top.
Who these terms are between
These terms apply to you (the person using the site) and to the operator of FreeHeadshot.org (referred to in this document as "we", "us", or "FreeHeadshot"). The legal entity behind the operator account is available on written request at [email protected] for purposes of formal legal correspondence.
References to "the service" or "the site" mean FreeHeadshot.org and any of its associated subdomains, application programming interfaces, mobile applications (when launched), and downloadable assets.
Acceptance and changes
By using FreeHeadshot in any way (visiting a page, generating a headshot, creating an account, paying for a tier), you agree to these terms and to our linked Privacy Policy, Refund Policy, and Acceptable Use Policy. If you don't agree, don't use the service. There is no middle ground.
We can update these terms. When we do, the "Last updated" date at the top of this page changes. For changes that meaningfully reduce your rights or increase your obligations, we will:
- Email everyone with an account at least 30 days before the change takes effect.
- Show a notice on the homepage for at least 14 days.
- Where the change is material enough that it would invalidate prior agreement, we will require active re-acceptance before letting paid users continue.
Older versions of the terms remain available on request. We do not silently change terms in a way that affects past purchases.
What FreeHeadshot is
FreeHeadshot is an AI image generation service. You upload one or more photos of your own face. The service uses an AI model to generate new images of your face in different styles, lighting, and backgrounds, suitable for use as professional headshots or social profile pictures.
The generation is performed by calling the Google Gemini 2.5 Flash Image API. We do not train, fine-tune, or operate our own image generation model. We compose the input prompt, send your uploaded photo to Google's API, receive the generated images, post-process them with standard image-editing operations (cropping, light tone correction, optional watermark), and return them to your browser.
The service is provided over the public internet. We do not guarantee any particular generation latency, output count, or aesthetic outcome. We do not guarantee that any specific style preset will continue to be offered in the future.
Eligibility and age
You must be at least 16 years old to use FreeHeadshot. Some jurisdictions set the minimum higher (18 in some US states, 14 in some EU countries with parental consent). Where local law sets a higher minimum, that local minimum applies.
You may not use the service on behalf of another person without their explicit consent. You may not generate images of any person who is not you, even with their consent, unless you have a documented contractual arrangement with that person and you keep records of that consent. The service is built to generate likenesses of the uploader, not of third parties.
Accounts and security
Most uses of FreeHeadshot do not require an account. The free tier works anonymously. If you upgrade to a paid tier, you create a lightweight account secured by a magic-link sign-in. We do not store passwords. You are responsible for keeping access to the email address you used to register, and for promptly notifying us if you suspect that someone else has gained access to your account.
We can suspend an account if it is being used in violation of these terms, the Acceptable Use Policy, or any applicable law. Where suspension is for cause and the user has paid for credits not yet consumed, we issue a prorated refund unless the violation is severe enough to forfeit the refund (impersonation, illegal content, fraud).
Free tier and paid tiers
The free tier provides three generations per day, limited to specific styles and watermarked output, with no account required. Free output is for personal evaluation only and is not licensed for redistribution or commercial use while it carries the watermark.
Paid tiers (currently Snapshot $9, Studio $19, Master $49 — see the pricing section for the current canonical list) are one-time purchases. They expand the per-day limit, unlock additional styles, remove the watermark, increase resolution, and grant a commercial-use license on the output. We may add additional tiers, rename existing tiers, or change the contents of a tier with notice. Prices in effect at the time of your purchase apply to that purchase.
Payments, billing, taxes
Payments are processed by Creem, a third-party payment processor based in the EU. We do not collect or store full card numbers. We see only the last four digits, the card brand, the billing country, and the Creem transaction reference, which we keep for tax and chargeback purposes.
Prices on the site are inclusive of any applicable VAT for EU/UK consumers. For non-EU/non-UK buyers, prices are exclusive of local sales taxes; you are responsible for any applicable local tax on top of the listed price. Creem applies the relevant tax at checkout based on your billing country.
Charge will appear on your statement as a descriptor from Creem. If you do not recognize the charge, email us before initiating a chargeback. Almost every "unrecognized charge" is resolved within an hour of email exchange.
Refunds (24h, ≤3 photos)
We refund any paid tier purchase, in full, within 24 hours of purchase, provided you have generated 3 or fewer photos from the pack. The 3-photo budget covers one full Generate click (= 3 photos), which is your quality check. The information we need from you is the email used at checkout and the order number from your receipt. Email [email protected] with the subject "Refund request" and we process within 3 business days.
Refunds after 24 hours, or after the 3-photo threshold has been exceeded, are at our discretion and considered case by case. If the tool genuinely failed for you (no usable output, persistent technical errors), we may refund even outside the window. If you simply changed your mind after using the pack, we cannot.
Once we refund a tier, your account is downgraded to the free Walk-In tier from that point forward. If you have downloaded images, they remain yours under the license that applied at the time of generation (refund does not retroactively cancel the license on files you have already saved).
EU and UK consumers retain the right of withdrawal under the Consumer Rights Directive and equivalent UK regulations. By starting a generation immediately after purchase, you expressly request that the digital service begin before the withdrawal period ends; in that case the right of withdrawal is consumed once the first generation has been delivered. The 24-hour contractual refund is a commitment we make on top of statutory rights, not a replacement for them. If you never used the tier (zero generations consumed), the EU/UK 14-day withdrawal right is fully intact regardless of our 24-hour policy.

Who owns the generated images
You own the images we generate for you, subject to the license terms below. We claim no copyright in the output of a generation you initiated.
For free-tier output that carries a watermark, the license is personal use only. You may share watermarked images on social platforms or send them to friends. You may not use them in paid commercial contexts (advertising, product packaging, paid sponsorships) while the watermark is present, because the watermark is the visible signal that the image is from a free tier.
For paid-tier output without a watermark, the license is broad commercial use: profile pictures on any platform, sales decks, marketing materials, conference badges, press kits, book covers, magazine bios, email signatures, business cards. Things you may not do with the output, even on a paid tier, are listed below in "Things you cannot do".
License you give us back
When you upload a photo, you grant us a non-exclusive, royalty-free, worldwide license to process that photo for the single purpose of generating your headshots and returning them to you. This license is the narrowest one we can write and still legally perform the service. It expires the moment the generation completes.
We do not acquire any other license to your images, your face, your likeness, or any derivative works. We do not have the right to publish, share, distribute, or sublicense your images or generated outputs. We do not have the right to use your face in marketing materials or example galleries.
Your responsibilities for what you upload
You promise three things when you upload a photo. These are not throwaway clauses — we rely on them, and you accept liability for them.
- The photo is of you, not of someone else. If you upload a photo of another person, you are responsible for any harm that follows.
- You have the right to use the photo. If it was taken by a professional photographer, you have permission from that photographer to use it for this purpose, or the photographer has assigned you the necessary rights.
- The photo does not contain content that is illegal in your jurisdiction or in ours.
If we have a reasonable basis to believe any of these representations is false (someone reports the photo, the result triggers our content filters, we receive a takedown request from the actual subject), we may suspend generation, retain the relevant data for compliance investigation, and report to law enforcement where required.
Things you cannot do
Some of these are obvious. We are still listing them because the absence of an explicit prohibition has been used as a defense in past AI image abuse cases, and we are not interested in giving anyone that defense.
- Generate images of any person who is not you, including celebrities, politicians, your ex, your boss, anyone.
- Generate images intended to impersonate another real person for any purpose (dating profile fraud, fake LinkedIn accounts, identity fraud, social engineering).
- Generate explicit sexual or violent imagery of anyone, including yourself. Our pipeline filters block these but if anything slips through, you do not have a license to use it.
- Generate images of minors. This includes images of yourself if you are a minor (see the eligibility section).
- Use generated images for biometric identification, surveillance, or to train other AI systems.
- Submit photos as part of any KYC or government identification process. AI headshots are not photographs and most jurisdictions do not accept them as such.
- Reverse-engineer, scrape, or attempt to extract the underlying model weights or prompts.
- Resell the service or any part of it, repackage the output as a product, or claim to be the operator of this service.
- Use the service through automation (bots, scrapers, scripted clients) beyond what a normal human user does. Where you need programmatic access, contact us about API access.
- Bypass quota limits using multiple email addresses, throwaway accounts, or IP rotation.
The full and current list is maintained at the Acceptable Use Policy. We update that page when new abuse patterns emerge.
AI output is not a guarantee
AI image generation is statistical. The same input can produce different outputs. The output may have artifacts (extra fingers, misshapen ears, lighting inconsistencies). The output may not match what you imagined. The output may produce a flattering result one time and an awkward one the next.
On paid tiers we provide more generations and stricter quality scoring so the chance of an unusable batch is low, but it is not zero. If you receive a batch that is unusable, regenerate. If repeated regenerations fail to produce a usable result, request a refund under the policy above and we will refund.
We do not guarantee that the output of any individual generation will:
- Match any specific reference image.
- Be a faithful reproduction of your real face — it is a generated likeness, not a photograph.
- Be free of features (glasses, jewelry, scars, tattoos, religious garments) present in the input.
- Be accepted by any third-party platform (LinkedIn, Tinder, government ID, etc.) as a photograph of you. Most platforms allow AI headshots; some do not. The decision is theirs.
- Be free of background elements (logos, signage, written text) that are statistical artifacts of the model.
Third-party intellectual property claims
If a generated image inadvertently includes content (a logo, a brand mark, a written phrase, a piece of architecture, an artwork) that resembles a third party's protected IP, you must not use the image in a way that would infringe that third party's rights. Where you become aware of any such content in your output, regenerate to obtain a clean version.
We respond to DMCA notices (United States) and equivalent IP takedown notices under the EU DSA and other relevant frameworks. Send notices to [email protected] with the subject "IP takedown" along with the standard sworn statements that the law requires. We act on valid notices within 5 business days.
Warranties (we don't make many)
The service is provided "as is" and "as available", to the maximum extent permitted by law. We do not warrant:
- That the service will be uninterrupted, timely, secure, or free from defects.
- That the output will meet any particular standard of artistic, photographic, or commercial quality.
- That the service will be free from errors, bugs, or vulnerabilities.
- That any specific style, feature, or model version will continue to be offered.
Where applicable consumer protection law guarantees specific warranties that cannot be disclaimed (digital content fitness, statutory consumer warranties under the EU Digital Content Directive, UK Consumer Rights Act), those statutory warranties apply on top of these terms. Nothing in these terms reduces a statutory warranty you have as a consumer.
Limitation of liability
To the maximum extent permitted by law, our aggregate liability to you for any and all claims arising from your use of the service is limited to the greater of: the amount you paid us in the 12 months preceding the claim, or fifty US dollars ($50). We are not liable for indirect, consequential, incidental, special, punitive, or exemplary damages, including lost profits, lost data, or loss of reputation.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities (notably gross negligence and willful misconduct). To the extent any provision of this section is unenforceable in your jurisdiction, that provision is replaced with the minimum enforceable equivalent and the rest of the section continues to apply.
Indemnification
You agree to defend, indemnify, and hold harmless FreeHeadshot, its operators, contractors, and processors from any claim, demand, or expense (including reasonable legal fees) arising from your violation of these terms, your violation of any law, or any third-party claim that your use of the service caused them harm. This includes claims by people whose likeness you generated without authorization and claims by holders of intellectual property that appears in your output.
We retain the right to assume exclusive defense and control of any matter for which you owe indemnification, in which case you agree to cooperate with our defense.
Termination
You can stop using the service at any time. If you have an account, you can delete it by emailing us; we will process the deletion within 7 days and follow the data-retention rules in the Privacy Policy.
We can suspend or terminate access for any account that materially violates these terms or the AUP. Where the violation is technical (a bug, accidental abuse, misunderstood rule) we will reach out before terminating. Where the violation is severe (illegal content, fraud, repeated harassment, deepfake creation) we may terminate without notice.
On termination, the licenses you granted us (the narrow processing license on your uploads) terminate with the service, and the licenses we granted you (the use rights on generated output) survive.
Disputes and arbitration
We genuinely prefer to handle disputes by email. Before bringing any formal legal action, please email us at [email protected] with the subject "Dispute" and a description of the issue. We commit to responding within 7 business days with a proposed resolution. Most disputes resolve at this stage.
If informal resolution fails, the dispute will be resolved as follows depending on where you live:
- EU/EEA and UK residents: disputes go to the competent courts of the consumer's country of residence under EU Regulation 1215/2012 and equivalent UK rules. EU users can also use the European Commission's Online Dispute Resolution platform at
ec.europa.eu/consumers/odr. Nothing in these terms forces an EU/UK consumer into arbitration. - US residents (and other non-EU/UK consumers): disputes are resolved by binding arbitration under the rules of a recognized arbitration provider (JAMS streamlined rules or equivalent), with the seat of arbitration in the jurisdiction of the operator entity. You may opt out of arbitration within 30 days of first agreeing to these terms by emailing us "I opt out of arbitration" with your account email; opt-out is permanent for that account.
- Class action waiver (US arbitration only): where arbitration applies, disputes proceed on an individual basis. Class arbitration is not permitted. This waiver is unenforceable in any jurisdiction where it is illegal, in which case the relevant portion of the dispute is severed and resolved in court.
Consumer rights (EU and UK)
If you are a consumer in the EU/EEA, UK, or Switzerland, certain rights apply under your local law regardless of what these terms say. Specifically:
- Your statutory withdrawal right under the Consumer Rights Directive, subject to the conditions in the refund section above.
- Your statutory guarantee of conformity for digital content under the Digital Content Directive and equivalent UK legislation.
- Your right to bring claims in your local court system.
- Your right to use the EU ODR platform.
Nothing in these terms reduces those rights. Where these terms conflict with a non-waivable consumer right, the consumer right wins.
Misc. legal boilerplate
Entire agreement. These terms, the Privacy Policy, the Refund Policy, and the Acceptable Use Policy together form the entire agreement between you and us regarding the service. Any prior agreements are superseded.
Severability. If any part of these terms is held unenforceable by a court of competent jurisdiction, the unenforceable part is severed and the rest stays in effect.
No waiver. If we don't enforce a right under these terms in a particular case, that doesn't waive the right in future cases.
Assignment. You cannot assign these terms to anyone else without our consent. We can assign them to a successor in the event of a sale of the business, with reasonable notice to active users.
Force majeure. Neither party is liable for failures caused by events outside reasonable control (large-scale infrastructure outages, war, natural disaster, change of law).
Notices. Notices to you go to the email you provided at signup. Notices to us go to [email protected].
Survival. Sections covering output license, IP claims, warranty disclaimers, liability limits, indemnification, and dispute resolution survive termination of these terms.
Language. These terms are written and binding in English. Translations are provided for convenience; if there is a conflict between a translation and the English version, the English version controls.
